RE: The tariff classification of narrow woven fabric and labels from Hong Kong

Dear Ms. Dearinger:

In your letter dated January 31, 2000, you requested a classification ruling on behalf of Seattle Garment Exchange.

Five samples, lettered “A” through “E” were submitted. All of the samples are made of woven fabric. Sample “A” is called a hanger tape made of a twill weave. It is 3/8 inches wide and is imported on rolls. It is made of 100 percent cotton. Sample “B” is a 100 percent polyester blank narrow woven fabric. It measures 1 and 3/8 inches in width and is imported on rolls in lengths of 250 yards. It will be used in the United States to label garments. Sample “C” bears the same physical description as sample “A” but it has a company name printed along its entire length. Sample “D” is made of 100 percent woven polyester. It has a company name and logo woven into the fabric. It measures 1 and 3/8 inches in width and approximately 3 and 1.4 inches in length. The ends are simply cut and folded under. Sample “E” is a printed label measuring 1 and 3.4 inches by 2 inches.

The applicable subheading for “A” will be 5806.31.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for narrow woven fabrics, other woven fabrics, of cotton. The duty rate will be 9.3 percent ad valorem.

The applicable subheading for “B” will be 5806.32.1090, Harmonized Tariff Schedule of the United States (HTS), which provides for narrow woven fabrics, other woven fabrics, of man-made fibers, ribbons, other. The duty rate will be 7.2 percent ad valorem.

The applicable subheading for “C” will be 5807.10.0510, Harmonized Tariff Schedule of the United States (HTS), which provides for labels, badges and similar articles of textile materials, in the piece, in strips or cut to shape or size, not embroidered, woven, labels, of cotton or man-made fibers, of cotton. The duty rate will be 8.3 percent ad valorem.

The applicable subheading for “D” and “E” will be 5807.10.0520, Harmonized Tariff Schedule of the United States (HTS), which provides for labels, badges and similar articles of textile materials, in the piece, in strips or cut to shape or size, not embroidered, woven, labels, of cotton or man-made fibers, other. The duty rate will be 6.3 percent ad valorem.

“C” falls within textile category designation 369. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

“D” and “E” fall within textile category designation 669. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
